Terms and Conditions

 

Overview:

Welcome to Artella.ca. These terms and conditions (“terms” or “user agreement”) is a contract between you and Artella Art Shop (collectively “Artella.ca”, “we”, “us” or “our”) governing your use of our website at Artella.ca (the “Site”), any mobile applications (“Apps”) that hyperlink to this Agreement, or any other websites, pages, features, or content owned and operated by us that hyperlink to this Agreement (collectively, including the Site and Apps, the “Services”).

By accessing or using the Services in any manner, including, but not limited to, visiting or browsing the Site, registering an account (as a buyer or seller), or contributing content or other materials to the Site, you expressly understand, acknowledge and agree to be bound by the Terms of Use. You are only authorized to use the Services if you agree to abide by all applicable laws and to these Terms.

In addition, you may read our Privacy Policy [link] at any time for more information about how Artella.ca collects, stores, and protects your information when you use the Services.

We reserve the right to modify the Terms of Use, including the Privacy Policy, at any time, in our sole discretion.

 

Section 1: Everyone

1.1. Account Creation and Termination:

In order to access some features available on the Services, you will have to create an account. You may not use another person’s account. Each time you use a password or identification, you will be deemed to be authorized to access and use the Site or Apps in a manner consistent with the terms and conditions of this Agreement, and Artella has no obligation to investigate the authorization or source of any such access or use of the Services.

You will be solely responsible for all access to and use of the Services by anyone using the password and identification originally assigned to you whether or not such access to and use of this site is actually authorized by you, including without limitation, all communications and transmissions and all obligations (including, without limitation, financial obligations) incurred through such access or use. You are solely responsible for protecting the security and confidentiality of the password and identification assigned to you. You shall immediately notify Artella of any unauthorized use of your password or identification or any other breach or threatened breach of the Site or App’s security.

Artella.ca members are required to provide accurate contact information such as their name, address, or telephone number when registering on Artella.ca. Artella.ca members are not allowed to use a fax or disconnected number as a telephone number.

Artella.ca services are only available to users who are 18 years of age or older and can legally create a binding contract between buyer and seller. Users who are not 18 years of age can participate if they are supervised at all times by a parent or legal guardian over the age of 18. The user or parent/legal guardian agrees that Artella.ca shall not be held responsible for any damages incurred by non-commitment to this policy.

Any material you upload to Artella.ca will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to Artella.ca constitutes a violation of their intellectual property rights, or of their right to privacy. We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of Artella.ca. We have the right to remove any material or posting you make on Artella.ca if, in our opinion, such material does not comply with the standards set out in our acceptable use policy.

Make sure you follow these guidelines. If you don’t, you may be subject to a range of actions, including restrictions of your buying and selling privileges and suspension of your account.

What are the guidelines?

  • Providing your correct name, address, and telephone number
  • Keeping your contact information up-to-date.

Not Allowed:

  • Falsifying or omitting contact information such as a name, address, or telephone number
  • Failing to register a contact name along with the business name, for a business account
  • Using a fax number as a telephone number
  • Using a disconnected telephone number

1.2. Offering to buy or sell outside of Artella.ca policy:

Offering to buy or sell outside of Artella.ca is not allowed. Buyers and sellers also can’t share contact information, including email addresses and phone numbers, prior to completing a transaction on Artella.ca.

Contacting another Artella.ca member to discuss moving a purchase off Artella.ca exposes both the buyer and seller to the risk of fraud. It also means both buyer and seller are not covered by our protection programs.

Buyers and sellers can’t:

·       Engage in any action with a user on the site designed to complete or facilitate a transaction outside of Artella.ca

·       Share or request direct contact information prior to completing a sale

·       In any communications with another Artella.ca member, refer to or promote external websites that facilitate sales outside of Artella.ca

·       Use contact information obtained through an Artella.ca transaction to offer to buy or sell an item outside of Artella.ca

·       List an item and then mention or link to additional identical or related items for sale outside of Artella.ca

·       Offer catalogs or other items that are used to order items directly outside of Artella.ca

·       Host item descriptions or images outside of Artella.ca

 

Buyers and sellers should

Complete purchases on Artella.ca in order to be covered by Artella.ca protections. Confirmation of a completed transaction on Artella.ca can be obtained by:

o   Using the Artella.ca checkout to complete the purchase

o   Viewing the purchase in purchase or sales history

1.3. Report an issue with a user

You should only report a user if you think they’re violating our policies. For example:

·       They offer to sell you a listed item outside of Artella.ca

·       The seller who does not intend to complete the sale

·       They send threatening messages or use abusive or vulgar language

·       They published another member’s contact information

·       The user gave you false contact information

·       You suspect the user is under the age of 18

 We take all reports seriously, but please make sure your claims are accurate

False Reporting

Artella.ca does not permit members to abuse the reporting process. Reports of policy violations to Artella.ca must be truthful and submitted with the intent of addressing a known or suspected violation of Artella.ca policy. 

Violations of this policy may result in a range of actions, including:

  • Listing cancellation
  • Limits on account privileges
  • Account suspension
  • Forfeit of Artella.ca fees on cancelled listings
  • Feedback removal

False reports of policy violations delay the review processes of genuine reports, which is detrimental to the Artella.ca community.

1.4. User Agreement policy

Everyone registered on Artella.ca has agreed to comply with our User Agreement and all other site policies. When using Artella.ca Services, members must:

·       Comply with our policies about listing on Artella.ca

o   Provide complete and accurate information in their listings

o   Avoid relisting items that we removed because they violated a policy

o   Avoid providing false or incomplete information to circumvent our policies

 

·       Comply with our policies about what kinds of items can be listed on Artella.ca. Members must not:

o   List counterfeit or prohibited items

  • Comply with our policies about how they use their account

o   Members must not do anything that might compromise the safety or integrity of the Artella.ca marketplace

o   Members must offer retail service levels, and deliver on their service promises

o   Buyer claims must be quickly addressed, within Artella.ca specified timeframes

o   Members must not create additional accounts to circumvent selling restrictions, buying limits, suspension, or to manipulate any site feature

o   Selling an Artella.ca User ID or account without our permission is not allowed

o   Scraping or gathering information from Artella.ca to use on another site is not allowed

  • Comply with our policies about how they use our site features

o   Members should only use Artella.ca site features and processes for its intended purpose

1.5. Threats and offensive language policy

·       It is strictly prohibited to engage in threats of bodily or physical harm or any kind of harassment using any method including by email, member to member messaging, on our public message boards (such as our discussion boards, groups, and other community areas) or within feedback comments

o   If a member receives a threat, it should be reported to local law enforcement

·       Hateful, obscene, offensive, profane, racist, sexual, defamatory, or violent language cannot be used in profiles, user IDs, chat rooms, discussion boards, member communication, Artella.ca Claims, Artella.ca Stores, feedback, listings, product pages, collections, and any other areas of the site

·       We don’t tolerate threats of physical harm using any method including by email or on our public message boards (such as our discussion boards, groups, and other community areas).

·       Example: “If I don’t hear from you by tomorrow about the item I purchased, I will come over to your house and break your legs.”

·       If you receive a threat, report it to local law enforcement. You should also consider contacting your local phone company if the threat was made by telephone, or the other member’s Internet service provider (ISP) if the threat was made through email communication.

Members aren’t allowed to use profanity or hate speech in their communications with other members through Artella.ca.

1.6. Member-to-member contact policy overview

Members can send messages to each other through Artella.ca. We encourage open communication between our members but we don’t allow our members to use these options to send spam, offers to buy or sell off Artella.ca, threats, profanity, or hate speech. We also don’t allow members to offer, reference, or request email addresses, phone numbers or other contact information, physical addresses, web addresses, or links within Artella.ca messaging systems (for example Best Offer or My Messages) or in any email communication managed by Artella.ca. Artella.ca may monitor messages sent through Artella.ca and between users for fraud, abuse, spam, and other violations of Artella.ca’s policies.

Activity that doesn’t follow Artella.ca policy could result in a range of actions including, for example: canceling listings, hiding or demoting all listings from search results, blocking some or all of your messages/communication with other members (including deleting, removing, or obfuscating all or part of any such communication), lowering seller rating, buying or selling restrictions, reporting to law enforcement, and account suspension. All fees paid or payable in relation to listings or accounts on which we take any action will not be refunded or otherwise credited to your account.

Please remember that we don’t have control over communication unless it takes place through Artella.ca.

We don’t allow our members to send each other spam. “Spam” is an email (or part of an email) that is both unsolicited and commercial in nature.

Unsolicited means the person who received the message didn’t request it. Commercial means the message discusses buying, selling, or trading of goods or services.

Some examples of spam include:

  • Unsolicited email offers sent to potential buyers
  • Email messages sent to a member on a mailing list without that member’s prior permission
  • Invitations to join a mailing list that aren’t related to your Artella.ca art shop
  • Offers to buy or sell off Artella.ca
  • Email sent using Artella.ca Messages (or features such as the Contact member link) to send unsolicited commercial offers

Not allowed

  • Offers to buy or sell items outside of Artella.ca
  • Messages that include email addresses, phone numbers, or social media links, contact information or usernames
  • Messages that include links or web addresses
  • Email and websites impersonating Artella.ca – Some members have reported receiving requests for personal information in email messages that look like they were sent from Artella.ca, but weren’t.
  • Sellers cannot show or link to direct email addresses in the listing or store pages (instead buyers can use the “Ask a Question” feature at the bottom of the item description to send email messages to the seller or “Inquiry” in the store profile)

1.7. Community content policy

We offer a wide variety of forums where the Artella.ca community can provide content, including Reviews, Guides, collections, member-created products and product descriptions, comments and more. This gives you access to factual information, personal opinions, and guidance on various topics and allows you to publish your opinions and content on our site.

Community content published or edited by our members is solely the opinion and responsibility of the persons posting the content. All content and behavior in posting or receiving such content must comply with the Artella.ca User Agreement, this policy, and other site policies.

It’s important that your content follows these guidelines. If it doesn’t, it may be removed or hidden, and you may be subject to a range of other actions, including restrictions of your buying and selling privileges and suspension of your account. To report violations of this policy, contact us.

Other Rules

  • You must be a registered and active member of Artella.ca to post a comment
  • We may use your Artella.ca username and profile picture, if you have one, to identify you to other users as the person who posted your content
  • We may promote, demote or remove any of your content in community content areas in our sole discretion
  • Users who create collections may remove any comment on their collection
  • We may limit the amount of community content you post
  • When a user refers in community content to an individual, or to a third party’s product, service, or trademark, that does not mean Artella.ca endorses or claims any endorsement by the individual or third party, nor does it mean we are affiliated
  • You acknowledge that all posts you make are public
  • While we may moderate or monitor any comment, we take no responsibility and assume no liability for any comment posted by you or a third party

1.9. Underage user policy overview

You must be at least 18 years old to be an Artella.ca member.

A person under 18 can use an adult’s account with the permission of the account holder. However, the account holder is responsible for everything done with that account.

Make sure you follow these guidelines. If you don’t, you may be subject to a range of actions, including limits of your buying and selling privileges and suspension of your account.

If you think another member is under 18, please report them to us via “contact us” form. Make sure to include any relevant information about why you think the member is underage. If you have an email from the member, please be sure to include a copy of it.

1.10. Dispute Resolution

Artella.ca has no obligation to resolve disputes between users or between users and outside parties. To the extent that Artella.ca attempts to resolve a dispute, Artella.ca will do so in good faith based solely on Artella.ca policies. Artella.ca will not make judgments regarding legal issues or claims. Artella.ca may help users resolve disputes in cases that the platform is directly involved with transactions.

Any dispute arising from or relating to the subject matter of this Agreement shall be finally settled by arbitration in Ontario, Canada, using the English language in accordance with the Arbitration Rules and Procedures of The Department of Justice, Canada. Judgment upon the award so rendered may be entered in a court having jurisdiction or application may be made to such court for judicial acceptance of any award and an order of enforcement, as the case may be. Notwithstanding the foregoing, each party shall have the right to institute an action in a court of proper jurisdiction for injunctive or other equitable relief pending a final decision by the arbitrator. For all purposes of this Agreement, the parties consent to exclusive jurisdiction and venue in the Canadian Courts.

1.11. Hacking and Viruses

You shall not attempt to gain unauthorized access to Artella.ca, the server on which Artella.ca is stored or any server, computer or database connected to our site. You shall not abuse Artella.ca by knowingly introducing viruses, Trojans, worms, logic bombs or other material that is malicious or technologically harmful. You shall not attack Artella.ca via a denial-of-service attack or a distributed denial-of service attack.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of Artella.ca or to your downloading of any material posted on it, or on any website linked to it.

1.12. Copy Right

All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of WWW.ARTELLA.CA or its content suppliers and sellers and protected by international copyright laws. The compilation of all content on this site is the exclusive property of www.Artella.ca, with copyright authorship for this collection by www.Artella.ca, and protected by international copyright laws.

 

Section 2: Buyer

2.1. Rules for buyers – overview

We want to maintain a safe, fair, and enjoyable marketplace for both buyers and sellers. If you’re a buyer, we ask that you review and understand our policies, including the Artella.ca User Agreement before you buy an item. By buying an item, you are agreeing to all of our rules and policies, including the Artella.ca User Agreement.

2.2. Guidelines for buyers

The abusive buyer policy outlines the type of behavior that we don’t allow from buyers, such as making unreasonable demands of a seller, misusing returns, or misusing the Artella.ca in any other way. If you’re also a seller, please be sure to read our rules for sellers, and make sure that your listings follow our guidelines.

Rules about buying and paying

  • You can’t use Artella.ca if your account contains false contact informationBuyers and sellers sometimes need to be able to get in touch with each other, and we need to be able to contact our members
  • You can’t offer to buy items outside of Artella.ca. Our policies don’t cover items bought outside of our site. If you buy items outside of Artella.ca, we don’t protect you against fraud. Sellers must follow the same rule, so if a seller offers to sell you something outside of Artella.ca, don’t accept the offer. (See section 1.2 for more information)

Rules about feedback

  • You can’t abuse the feedback system

This means you can’t threaten to leave a seller negative feedback if that seller won’t do something that wasn’t promised in the original listing. This is called feedback extortion and is against our policy.

Also, you can’t leave feedback if you’re only doing it to help increase a seller’s feedback score. This is a type of feedback manipulation and is also not allowed.

Make sure that you understand and follow all of our feedback policies.

If you’re having a problem with a seller

  • Be honest and have good intentions when you try to resolve a transaction problem.
  • You can’t try to contact other potential buyers to “warn” them about a seller. This is called transaction interference. If you have a concern about a seller’s behavior, report it to us and we’ll investigate

Reporting policy violations

If you want to report a policy violation:

1.    First, read the policy page that deals with the violation (see our rules and policies) and make sure the other member is really breaking the rules.

2.    If you still want to report a member, contact us.

Reports of policy violations must be specific and you must submit them with the intent of addressing a known or suspected violation of our policy.

False reporting of policy violations can have serious consequences.

Report a listing only once. Multiple emails about the same listing slow down our investigation.

When we receive your report, we look at all the circumstances, including the member’s history, before we decide whether to take action. If we aren’t sure about something or can’t prove it with certainty, we may not take any action. In addition, we won’t discuss the results of an investigation.

2.3. Return policy

Artella.ca is an online shop that showcases service providers, artists, and designer’s handmade independent pieces. Artella.ca is a marketplace where vendors oversee making their own policies about Returns and Exchanges. Guidelines may vary for each seller. For buyers to understand each seller’s policy they must study everyone’s policy separately and there is more information available on the seller’s profile as well as the product page on Artella.ca. Generally, sellers accept returns and exchanges within 14 days of the order placement. Returns and Exchanges are not available for those items that are customized for the buyer, used or not in the same condition of when the item is bought. Please note, buyers are responsible for their own shipping when returning an item unless the item received from seller is damaged. In this case, the seller is responsible to pay for the shipping, so the item is returned. Should you have any concerns regarding your order you can contact the seller via your Artella.ca account. When opening a return request, seller may ask you to upload an image. You may provide only images that are relevant to why you are returning the item.

Section 3: Seller

Our art policy is designed to create a safe marketplace for buyers and sellers of art and handmade goods.

3.1. Artwork’s policy

you can sell your original artwork and other artwork that you’re authorized to resell on Artella.ca.

Make sure your listing follows these guidelines. If it doesn’t, it may be removed, and you may be subject to a range of other actions, including restrictions of your buying and selling privileges and suspension of your account.

Our policy outlines restrictions related to the sale of many kinds of artwork. For example, the policy gives guidance on how to handle sales of items such as:

·       You may only sell a reproduction (in the form of a poster, print, or exact replica painting) if it does not violate any applicable laws, copyrights, or trademarks

·       When listing an exact replica painting:

The words “Reproduction” or “Repro” must be included in the title

The item description must clearly state that the work is a reproduction

You may include the artist’s name in the title of the listing only when listing a work by the artist him/herself or an exact replica of the artist’s work. You may not include the artist’s name when listing a work done “in the style of” an artist

·       If any alterations, conservation, or repairs have been performed on the work of art, you must disclose this information in a clear and prominent manner within the item description

3.2. Prohibited items policy

  • Knowingly selling, exhibiting, trading, producing, or advertising any unauthorized copy or reproduction of any work of art
  • Disclaiming knowledge of, or responsibility for, the authenticity or legality of an item that you describe as genuine
  • Describing or marketing any item as genuine if you cannot provide reasonable evidence to prove its authenticity
  • Knowingly participating in any way in the advertisement or sale of any work of art using any deceptive practices, including, but not limited to, false or misleading claims of the item’s scarcity, value, provenance, condition or investment potential
  • Items or products that contain profanity in the official title are allowed, as long as they follow these guidelines:
    • CDs, DVDs or other media with titles that include language which may be considered to be profane are allowed on Artella.ca as long as any profane words are part of the official title
    • Adult items that include language which may be considered to be profane as part of their official title or description must be listed in the Adult Only category
    • Novelty items (shirts, hats, etc.) containing profanity may be listed if the profane word is blurred out completely in any images, and the majority of the word has been replaced with asterisks in the item listing

3.3. Adult items policy

We have policies to ensure our platform remains a trusted and inclusive environment for our global community of buyers and sellers. Although most adult-only items are prohibited, listings that show nudity are allowed in limited situations when they follow the guidelines below.

We’re committed to preventing bias in the application of our policies. All forms of adult content that don’t follow our policy will be removed. We’ll review the content of the listing, images, and the category of the items to determine if it is allowed.

Artella.ca defines nudity as showing any part of male or female genitalia, anus, or female breasts where the areola or nipple is visible. The following are also considered nudity:

·       Modeled clothing that is see-through or very tight and shows human genitalia, the anus, or the nipple/areola of female breasts

·       Male erections, even if the model is clothed

·       People engaged in sexual contact or activity

 

The following items are not allowed:

·       Adult items with content that is illegal 

·       Sexually explicit materials, including items displaying sexual activities, are not allowed.

·       Nude art listings that do not contain sexually suggestive poses or sexual acts are allowed, but they must include the item specific attribute Subject: Nudes.  They can be listed only in the Art, Collectible or Vintage categories:

·        

·       Activity that doesn’t follow Artella.ca policy could result in a range of actions including for example: administratively ending or canceling listings, hiding or demoting all listings from search results, lowering seller rating, buying or selling restrictions, and account suspension. All fees paid or payable in relation to listings or accounts on which we take any action will not be refunded or otherwise credited to your account.

3.4. Cultural and historical items policy

·       Items obtained from government or protected land, historical grave sites, or shipwrecks, can’t be sold on Artella.ca

·       Looted or stolen goods can’t be sold on Artella.ca

Listings for artifacts, fossils, and relics must:

·       Follow all government regulations

·       Be authentic and listed in the appropriate category

Listings for replicas must:

·       State the item is a replica in the title and description

·       Be listed in the Reproduction or Fantasy category, as appropriate

Listings for antiquities must include the provenance or ownership history of the item and, where possible, a photo or scanned image of an official document including both the item’s country of origin, and the legal details of the sale. The item must also be approved for import or export

3.5. Autographed items policy

Since autographed items and trading cards are unique, they can be very valuable, but are also easy to forge or reproduce. Autographs are commonly sold with certificates of authenticity (COAs) and letters of authenticity (LOAs), while trading cards use a grading system. COAs, LOAs, and grades are meant to assure the buyer that the signature or item is genuine. However, COAs, LOAs, and grades are only as valuable as the reputation of the issuing party, so it’s important to know the reputation of each authenticator or grader.

We investigate concerns from our members in regard to autographs, COAs, LOAs, and trading cards. As part of this policy, we work with several reputable third parties. These third parties may use known authentic autograph examples to determine if these items are genuine or “likely not genuine.” If they have concerns about an item’s authenticity, Artella.ca may remove the listing from the site.

Make sure your listing follows these guidelines. If it doesn’t, it may be removed, and you may be subject to a range of other actions, including limits of your buying and selling privileges and suspension of your account.

You can list autographed items and most trading cards on Artella.ca. These guidelines will help you successfully sell these types of items on our website.

Be sure to include the following information in your listing:

  • A clear photo of the actual autographed item
  • A clear photo of the COA or LOA
  • Information about the COA or LOA, including the name of the person or company issuing the certificate
  • Refund policy, in case a reputable dealer informs us or the buyer that the item is “likely not authentic”
  • Authentic and authorized pre-printed autographs or autographed items should generally be listed in the Autographs-Reprints category. An authorized pre-printed autograph means a company has acquired the rights to accurately reproduce the original signed item

3.6. Electronic equipment policy

·       Listings for graded coins and currency must have been graded by an approved company.

·       Listings for ungraded coins and currency or raw currency:

o   Must not include a non-approved grading company, numeric grade or estimated value anywhere in the listing and can’t show an image of the item in a graded holder if the image shows a grade

o   Must include photos of the front and back of the actual item for sale (stock photos are not allowed) 

o   Must have a starting, reserve, or Buy It Now price of less than $2,500

·       Listings for current, exchangeable, ungraded currency from any country worldwide cannot exceed $1,000 in value, whether in a single listing or in a combination of multiple listings

3.7. Faces, names, and signatures policy

Sellers aren’t allowed to list an item that has an image (such as a photo), likeness (such as a drawing), name, or signature of another person on it unless the product was made or authorized by that person.

Make sure your listings and products follow these guidelines. If they don’t, they may be removed, and you may be subject to a range of other actions, including limits of your buying and selling privileges and suspension of your account.

  • A t-shirt with a picture of a movie star on it that was authorized by that person
  • A key chain with an unauthorized picture of a rock star on it (even if the seller took the picture at a concert)
  • A scanned copy of an original, signed picture of a baseball player
  • A mouse pad with an unauthorized picture of a movie star on it
  • A CD containing pictures of a singer taken from various sources on the Internet. (Even if a seller had permission to download the pictures, the seller probably doesn’t have the right to sell them.)
  • An unauthorized t-shirt with the name of a celebrity on it

3.8. Jewelry policy

If any part of the item is fine, including the gemstone(s) or the setting, the item should be tagged and described as Fine Jewelry.

Fine metals:

Gold of 10 karats or higher (yellow, rose, white), silver of 925 parts per 1000 pure silver or above, platinum group metals of 850 parts per 1000 pure platinum or above, black rhodium plated silver, bonded gold and silver (if gold plated sterling silver), brass plated gold (greater than 10k gold), chocolate gold, gold plated silver, green gold, palladium, platinum, platinum flashed silver, platinum plated (if platinum plated sterling silver), platinum plated silver, rhodium flashed silver, rhodium plated gold, rhodium plated gold and silver, rhodium plated silver, rhodium plated white gold, rhodium plated yellow gold, rose gold flashed silver, sterling silver, tri-color gold, vermeil, white gold plated silver, yellow gold flashed silver, yellow gold plated silver.

Fine gemstones

Gemstones and beads

Natural: Choose this option only if you have an unenhanced, untreated, natural gemstone.

Treated: If you are listing a natural gemstone that has been treated (for example: dyed to enhance the color), you are required to specify the treatment in the item specifics and description. You must also clearly specify the following in the item description:

    • The treatment is not permanent and loses its effect over time;
    • The treatment creates special care requirements for the gemstone to retain the benefits; and
    • The treatment has a significant effect on the gemstone’s value

Lab-created: Select this option only if you are listing a lab-created gemstone that has the same mineral composition as a natural gemstone. Do not list a lab-created gemstone in the Fine Jewelry category unless it is accompanied by a fine metal setting or other fine gemstone. You are required to identify the gemstone as “lab-created” in the title, item specifics and description immediately preceding the name of the lab-created gemstone. All lab-created gemstones not mounted on a fine metal setting or accompanied by a fine gemstone should be listed in the Fashion Jewelry category.

Simulated: Select this option if you are listing a simulated gemstone that has the same appearance but not the same mineral composition as a natural gemstone. A simulated gemstone should only be listed in the Fashion Jewelry category unless it is mounted on a fine metal setting or accompanied by a fine gemstone, in which case it should be listed in the Other or Simulated categories. If the mineral composition of the gemstone is different from the natural gemstone, you are required to identify the gemstone as “simulated” in the title, items specifics and description immediately preceding the name of the simulated gemstone. For example, “simulated ruby.” All simulated gemstones not mounted on a fine metal setting or accompanied by a fine gemstone should be listed in the Fashion Jewelry category.

Unknown: If you do not know if the gemstone has been enhanced or treated, or if it is lab-created or simulated, you should consider having the gemstone certified. All unknown gemstones should be listed in the Fashion Jewelry category unless mounted on a fine metal setting or accompanied by a fine gemstone.

Diamonds

1. Diamonds must clearly describe the creation method or treatment in all parts of the listing, including title, item specifics and description.

Natural, not enhanced: Choose this option only if you have an unenhanced, natural diamond.

Enhanced: If you are listing a natural diamond that has been enhanced (for example, “clarity-enhanced” to reduce flaws, dyed, etc.), you are required to include “enhanced” in the title and to specify the enhancement in the item specifics and description.

Lab-created: Select this option only if you are listing a lab-created diamond that has the same mineral composition as a natural diamond. Do not list a lab-created diamond in the Fine Jewelry category unless it is accompanied by a fine metal setting or other fine gemstone. You are required to identify the diamond as “lab-created” in the title, item specifics and description immediately preceding the name of the lab-created diamond. All lab-created diamonds not mounted on a fine metal setting or accompanied by a fine gemstone should be listed in the Fashion Jewelry category.

Simulated: Select this option if you are listing a simulated diamond that has the same appearance but not the same mineral composition as a natural diamond. A simulated diamond should only be listed in the fashion jewelry category unless it is mounted on a fine metal setting or accompanied by a fine gemstone, in which case it should be listed in the Other or Simulated categories. If the mineral composition of the diamond is different from the natural diamond, you are required to identify the diamond as “simulated” in the title, item specifics and description immediately preceding the name of the simulated diamond. All simulated diamonds not mounted on a fine metal setting or accompanied by a Fine Gemstone should be listed in the Fashion Jewelry category.

Unknown: If you do not know if the diamond has been enhanced, or if it is lab-created or simulated, you should consider having the diamond certified. All unknown diamonds should be listed in the fashion jewelry category unless mounted on a fine metal setting or accompanied by a fine gemstone.

2. A diamond is a mineral consisting essentially of pure carbon, crystallized in the isometric system with a hardness of 10, specific gravity of approximately 3.52 and refractive index of 2.42.

If the gemstone does not meet the above definition for a diamond, you cannot list your item as Diamond or Fine Jewelry category. If the mineral composition of the gemstone is different from the natural gemstone, you must clearly identify the item as such in all areas of your listing and product. For example, use words like “simulated” immediately preceding the use of diamond. You must also clearly describe the actual material the gemstone is made of in the item specifics and description, such as cubic zirconia, glass, rhinestone, etc.

3.9. Search manipulation policy

Manipulating Artella.ca’s search and browse experience by adding popular keywords in your listings that don’t have any relation to your items, or using other tactics that could mislead buyers, is not allowed.

To make sure our search results give buyers the best experience possible, it’s also important to accurately describe your items, use a clear title, and list in the appropriate categories.

·       Manipulating search results to gain unfair visibility of a listing is not allowed

·       Using keywords that are not directly related to the item for sale is not allowed. All the words in the listing need to be accurate and refer only to the item for sale

·       If the item is an accessory for or compatible with another item, “fits”, “for” or “compatible with” should be stated before the name of the compatible item. However, “fits”, “for” or “compatible with” is not allowed before the brand names of jewelry, clothing and accessories, or universally compatible items

·       Listings that make comparisons with other products are not allowed

·       Listings that promote other listings are not allowed

·       Listings can’t include keywords with question marks, as this can be misleading for buyers. If any item details are unclear or unknown, they should be left out of the listing

·       Offering a choice of different products in a single listing is not allowed. This includes:

o   Selling different items with different conditions in the same listing (for example, “new” and “used” items)

Some tips:

·       List identical items in one multi-quantity fixed price listing

·       List items with variations such as size and color in one fixed price listing with variations

·       Significant differences between items in a listing should be highlighted in the listing title, pictures, price, condition, and item specifics, so that buyers can easily tell them apart

3.10. Links policy

To protect our members, listings or products can’t contain links that direct customers to a site other than Artella.ca, even if the link is not clickable.

While there are some exceptions, listings or item descriptions can’t contain links that direct customers to any other site. We don’t allow store names to be a web address or include (for example) ‘.com’, ‘.net’, ‘.org’ or ‘.edu’

3.11. Picture policy

When you create a listing or product, you must include at least one photo. Photos are one of the most important parts of your listing because they allow potential buyers to see the item’s exact condition, and help them decide whether to buy. We recommend including more than one to help increase your chances of a successful sale.

The following are not allowed:

·       Photos that don’t accurately represent the item

·       Placeholder images used to convey messages

·       Stock photos for used, damaged, or defective items

·       Photos with added borders

·       Photos with added text, artwork or marketing material

·       Watermarks of any type, including those used for ownership attributions

 

3.12. Counterfeit item policy

Counterfeit products are illegal and not allowed on Artella.ca. Examples include:

o   Fakes, copies, or replicas of brand name items (for example, a shoe with the Nike name or logo that wasn’t made by Nike)

o   Electronics or accessories that use or bear the brand name, logo, or trademark of a company that didn’t manufacture the item

o   Bootleg recordings from concerts or other live shows

o   Unauthorized or pirated copies of movies, videos, or software

o   Listings with photos that hide or blur trademarks are not allowed

o   If you’re not certain that your item is authentic, or if an authenticator has been unable to confirm its authenticity, it may not be listed

o   We may remove listings if we receive buyer complaints that the item is not authentic. These items may not be relisted

o   Items that bear a company’s official brand name or logo can be listed, as long as the products were lawfully made by, for, or with the consent of that company.

3.13. Spam policy

Sellers can’t:

·       Send other members emails that are not directly related to a purchase or sale on Artella.ca

·       Contact other members to make offers to buy or sell items outside of Artella.ca, or use information obtained on Artella.ca to solicit sales outside of Artella.ca

·       Send messages that include email addresses, phone numbers, social media links, contact information, usernames, external web links or addresses, or other personal or business information

·       Send emails to other members that are unsolicited and commercial in nature

·       Add other members to mailing lists without their permission, or send invitations to other members to join mailing lists that are not related to an Artella.ca Store

·       Send messages impersonating Artella.ca

3.14. Government items policy

The following or similar items are not allowed:

·       Government, private transit, or shipping company uniforms and accessories such as hats, pins and scarves 

o   Vintage or collectible uniforms and accessories may be listed if they meet all these requirements: 

·       The item is 10 years old or older 

·       It’s no longer in use 

·       It doesn’t look like a current uniform or accessory 

·       Government, transit or shipping company property such as vehicles, license plates, keys for vehicles, mail bags, company decals and transit documents

·       Fake documents, government-issued documents or official certificates or diplomas

·       Postage meters, voting machines or Library of Congress National Library of Service record players, digital talking book machines or any of their labeled accessories 

·       Government-issued IDs, passports, birth certificates or license plates

o   Collectible license plates are allowed as long as they are expired and at least 3 years old or as allowed by law

·       Government-issued medals and certificates for medals

·       Vehicle Identification Number (VIN) plates or rivets

·       Signs or other items indicating use by a rideshare driver or delivery person

3.15. Knives policy

The following or similar types of knives aren’t allowed:

·       Automatic knives

·       Butterfly knives

·       Dual-action knives

·       Gravity knives

·       Out-the-front knives

·       Paratrooper knives

·       Push knives

·       Switchblade knives

·       Sword canes

·       Spring-assisted knives where there is no manual movement by a thumb stud or screw clearly visible on the blade

·       Hidden or disguised knives such as writing pen knives or belt buckle knives

Sellers can list the following type of knives:

·       All types of knives not in the previous list are allowed.

Replica, toys, prop guns or other imitation firearms can be sold as long as they follow these rules:

·       The seller follows all applicable government regulations

·       The item has a blaze orange barrel plug permanently attached

·       The picture shows the actual item for sale

·       The item description has the following disclaimer: “This replica gun contains the colored markings required by law, including a permanently attached orange plug.”

3.16. Firearms and accessories policy

Firearms are not allowed. Listings for allowed firearm parts and accessories must follow strict guidelines.

The following are not allowed:

·       Firearms of any type 

·       Parts and accessories for assault weapons, including blueprints and instructions

·       Any part or accessory in violation of local law

·       Firearm receivers, even if incomplete

·       Ammunition for firearms, including bullets, cartridges, casings, shells, and hulls 

·       The following firearm accessories are not allowed:

o   Frames, kits used to create a firearm, flash suppressors, silencers, sears, high-capacity magazines that accept more than 10 rounds (even if they have been modified to accept fewer), magazine extenders, bump fire stocks, grenade launchers, and pistol conversion kits

·       The following accessories for semiautomatic pistols are not allowed:

o   Barrel shrouds, forward pistol grips, and threaded barrels

Listings for firearms parts and accessories that we allow must follow these guidelines:

·       The listing must clearly identify the part or accessory being sold as well as the type of firearm it fits (“type” can mean general use and not necessarily brand or manufacturer). For example, “This part can be used with bolt-action rifles.”

·       The item must be listed on the US site (Artella.ca.com) and offer domestic shipping only

Examples of allowed firearm parts and accessories:

·       Barrels (exceptions: shotgun barrels less than 18 inches and rifle barrels less than 16 inches are prohibited)

·       Bolts

·       Choke tubes

·       Cylinders

·       Firing pins

·       Hammers

·       Slides

·       Trigger assemblies

3.17. No item listings policy

A listing must offer either a physical item, which includes digitally delivered goods, or a service for sale. Want ads, place holders, or offers to trade are not allowed.

Activity that doesn’t follow Artella.ca policy could result in a range of actions including for example: administratively ending or canceling listings, hiding or demoting all listings from search results, lowering seller rating, buying or selling restrictions, and account suspension. All fees paid or payable in relation to listings or accounts on which we take any action will not be refunded or otherwise credited to your account.

3.18. Creating a Product

If you don’t see a product in our catalog that’s a match for the item you’re trying to list, you can create a new product or suggest edits to an existing product in the catalog. When creating or editing a product, the information you provide must follow all of our other site policies unless specifically stated otherwise. All of the information you provide in a product must directly describe that item, and shouldn’t be about individual sellers, business, or transactions.

Here are some examples of content or actions that aren’t permitted in the community content areas (Reviews, Guides, member-created products or product descriptions, and comments). These examples provide guidance for self-publishing content on our site but shouldn’t be viewed as a complete list.

  • Promoting or advertising to buy, sell, or trade any product or service listed or located outside of any Artella.ca property (Artella.ca, Artella.ca Stores, etc.)
  • Placing published content or products in the wrong category (miscategorization)
  • Including feedback or comments about other users
  • Including unauthorized trademarked or copyrighted content (such as uploading photos or content for which you do not have permission to use)
  • Using another Artella.ca member’s pictures or text without the other member’s express permission
  • Using intellectual property without the property owner’s express permission, when required. Artella.ca strongly encourages members writing and publishing content to familiarize themselves with how Artella.ca helps protect intellectual property.
  • Creating products or updating products in the catalog in a way that would violate Artella.ca’s Prohibited and restricted items policy ; or Artella.ca’s Encouraging infringement policy (for example, creating and/or selling products that a manufacturer/brand does not make or that are counterfeit); or Artella.ca’s Listing Policies.
  • Including any advertising credit, including links, logos, or company names within published content
  • Publishing more than one identical piece of content or more than one identical product at the same time and in the same context
  • Encouraging, publishing, promoting, facilitating, or instructing others to engage in illegal activity or to violate Artella.ca policy
  • Publishing content in the incorrect forum
  • Publishing reviews that aren’t specific to the product
  • Enabling, encouraging, or instructing others to infringe copyrights, trademarks, or other intellectual property rights
  • Promoting giveaways, lotteries, random drawings, raffles, or prizes of any kind
  • Using HTML and JavaScript functions prohibited on Artella.ca.
  • Using keywords, random links, inaccurate titles, text, or other content not directly relevant to the subject of the community content for the purpose of gaining attention or diverting members to that content. For more information on misuse of keywords.
  • Publishing content or images that are adult in nature or otherwise not appropriate for minors (individuals under 18 years of age). See section 3.3. for clarification on what is permitted in public areas of the site
  • Linking from content published on Artella.ca to any third-party website, including those that include offers to trade, sell, or purchase goods or services off Artella.ca is generally not permitted
  • Linking to items, services, or content prohibited on Artella.ca or to sites that offer items, services, or content prohibited on Artella.ca
  • Misrepresenting yourself as an Artella.ca employee or as another Artella.ca member
  • Publishing content that promotes or glorifies hatred, violence, racial, or religious intolerance, or content that promotes organizations with such views. For more information.
  • Using profanity or patently vulgar language in a public area of the site
  • Publishing personal contact information of any person in any public area of Artella.ca, including emails, phone numbers, name, street address, etc.
  • Misusing the violation reporting function to maliciously or frivolously report content as not in compliance with Artella.ca policy
  • Artificially increasing or decreasing any community content, including ratings and reviews

Images, video and text policy when creating a product

When creating listings, store pages or product pages, sellers should write their own text and take their own photos and videos. Buyers like to see images, videos and descriptions that accurately represent the item they are purchasing. Your listings, stores pages, product pages, member communications and images uploaded when you return an item should follow this policy as well as our other policies. Images, videos and text you created yourself, without any third-party content or intellectual property

Restricted or not allowed

Unless you have explicit written permission from the respective rights owners to use the content on Artella.ca, you are not allowed to use third-party content, including but not limited to the following:

  • Images, videos or text copied from websites or internet searches
  • Information from product packaging
  • It’s usually OK to use information such as measurements, weight, or other item specifications that are necessary to describe the item that you simply can’t say any other way. However, you should avoid using any other text from product packaging.
  • Scans or text copied from catalogs or advertisements
  • Poor-quality videos or images that are blurry, undefined or distorted
  • Illegal content that doesn’t follow our policy.
  • Offensive content that promotes or glorifies hatred, violence or discrimination under our policy.
  • Videos that include nudity or sexually oriented materials or that are not allowed by our adult items policy
  • Directing buyers off Artella.ca, including any contact information, web links, or not following our Offering to buy or sell outside Artella.ca policy
  • When opening a return request, we may ask you to upload an image. You may provide only images that are relevant to why you are returning the item.

Sellers are prohibited from activities that avoid Artella.ca fees, intentionally or not. This includes:

·       Making offers to buy or sell outside of Artella.ca

·       Linking or promoting sites, items, or catalogs that can be used to order items outside of Artella.ca

·       Requiring a buyer to make additional purchases or to agree to terms outside of the listing

·       Charging excessive shipping and additional fees not already included in the price of the item, or passing seller fees on to the buyer

·       Listing items outside of the correct category

·       Falsely canceling orders using Buyer hasn’t paid as a reason, or refusing payment at the end of a successful transaction

·       Changing the information in a listing to sell a different item instead of listing a new item

·       Selling completely different brands, models, or types of items as choice listings, such as:

o   Selling items with different conditions such as “new” and “used”

Sellers are responsible for paying fees for all sales made using some or all Artella.ca services, even if the sale terms are finalized, or payment is made outside of Artella.ca.

3.19. Seller performance

Artella.ca expects sellers to consistently provide service that results in a high level of buyer satisfaction. This includes setting and meeting buyer expectations by providing excellent customer service from beginning to end.

You can see how you’re performing both domestically and across various international markets in your vendor dashboard. Specifically, you can view how well you’re meeting buyer expectations with buyers from Canada and global markets.

As a seller, you’re expected to:

  • Promptly resolve customer issues
  • Ship items on time, within your specified handling time
  • Manage inventory and keep items well stocked
  • Charge reasonable shipping and handling costs
  • Specify shipping costs and handling time in the listing
  • Follow through on your return policy
  • Respond to buyers’ questions promptly
  • Be helpful, friendly, and professional throughout a transaction.
  • Make sure the item is delivered to the buyer as described in the listing

Keep in mind, too, that if you don’t meet buyers’ expectations, it can lead to:

  • A bad experience for you and the buyer
  • Low detailed seller ratings
  • Negative or neutral feedback from a buyer
  • A buyer requesting a return or reporting that an item was not received
  • A buyer asking us to step in and help with a transaction issue

Fair performance evaluation

To measure your overall performance accurately, we look at your performance as a whole. We also consider a buyer’s pattern for opening requests and cases and leaving low detailed seller ratings—and protect you when necessary.

 

What happens if your seller level is Below Standard?

If you don’t meet our minimum performance standards, we may put limits on your selling activity until your performance improves.

The consequences of falling Below Standard can include:

  • Your items may be placed lower in search results
  • We may limit or restrict you from selling on your account and related accounts, or from registering a new account
  • Funds from your sales may be held
  • You will be blocked from using the Promoted Listings tool, and will not be able to create new campaigns or edit existing campaigns
  • You’ll be unable to access the partial refund tool

Usually, we will only apply permanent selling restrictions when your account has been evaluated as Below Standard for at least 2 consecutive months. However, we may take action at any time if we have urgent concerns about your account; for example, if we’ve detected fraud or if your selling practices pose a threat to the buyer experience. The actions we take will be proportional to the nature of the issue we have identified and what is reasonably required to protect the interests of all Artella.ca users and Artella.ca as provider of the services.

If your account isn’t meeting our minimum performance standards, you should:

  • Resolve all issues on the account before buying or selling with other accounts
  • Review your listings to make sure that you’re describing your items accurately. Use pictures and include specifics in your listing so your buyers know exactly what to expect
  • Make sure that you respond promptly to requests from buyers

 

Activity that doesn’t follow Artella.ca user agreement could result in a range of actions including for example: administratively ending or canceling listings and/or membership, hiding or demoting all listings from search results, lowering seller rating, buying or selling restrictions, and account suspension. All fees paid or payable in relation to listings or accounts on which we take any action will not be refunded or otherwise credited to your account.
